This Day In Gay Utah History April 8th

8 April
1476-An anonymous note was dropped in a "morals box" accusing an artist's model named Jacopo Saltarelli of Florence Italy of sodomy with four men, one of whom was Leonardo da Vinci. He was eventually acquitted, but the two months of questioning by police took its toll on him physically.

1901 Tramps Arrested Two tramps who gave their names as Frank Beason and William Dean were arrested last evening on a charge of sodomy. The victim of the two men was John Langenbucker a 14year old lad who lives at 557 West North Temple street
1901 William Dean Case No. 721 Third District Judicial Court: William Dean was Charged with Crimes Against Nature. William Dean and Frank Brown were both charged by John Langenbucher (Langenbecker) with having sexual relations with his thirteen year old son, also named John. Langenbucher was a German native who resided at 557 West North Temple SLC at the time. The 1910 Census of Utah lists Langenbucher as being born in 1848 making him 53 years old at the time of the complaint. The only William Dean in the 1900 Census of Utah was a 35 year old married family man who lived in Sugar House. This was not the same man because the accused was a transient. On this ninth day of April A.D. 1901, before me J.B. Timmony Justice of the Peace, within and for City precinct, Salt  Lake County, State of Utah, personally appeared John Langenbecker who on being duly sworn on his oath did say that the said William Dean on the 8th day of April, A.D. 1901, at the county of Salt Lake, State of Utah, feloniously, wickedly, and against the order of nature, had a venereal affair with said John Langenbecker, did commit and perpetrate the detestable “Crime Against Nature”, of Buggery, with said John Langenbecker and then and there feloniously, and wickedly, and against the order of nature, did commit and perpetrate the detestable “Crime Against Nature”, of buggery, with said John Langenbecker, then and there being a male person, contrary to the provisions of the statute of the State aforesaid, in such cases made and provided and against the peace and dignity of the State of Utah. Signed by John Langenbucher.  Subscribed and sworn to before me, the day and year above written. J.B. Timmony. VILE CRIME IS CHARGED Two Men Accused of Committing a Beastly Offense William Dean and Frank Beacon, two transients, were arrested yesterday afternoon by Officer FitzMaurice on a charge of Sodomy. The victim of their alleged crime is J. Langenbacker, a lad of fourteen years, who say the prisoners are guilty of the crime charged against them. The arrest was made in a box car at the Rio Grande yards, where it is said the offense was committed. Dean and Beacon were locked up pending arraignment, (Daily Salt Lake Tribune 9 April 1901 page 8) HELD FOR TRIAL ON CHARGE OF VILENESS William Dean and Frank Brown, the two boxcar tourists who were arrested at the Rio Grande Western Railway yards on the charge of Sodomy were arraigned yesterday. Both pleaded not guilty and said they desired to waive examination. The ease with which they conducted themselves and their familiarity with the law showed plainly that this was not their first time they had been before a court. They were allowed to waive examination and in default of $3000 bail each were committed to the custody of the sheriff to wait trial by District Court. (Daily Salt Lake Tribune 10 April 1901 Page 8) Information:  William Dean, having heretofore been duly committed by J.B. Timmony, a Committing Magistrate of this county, to answer to this charge, is accused by Dennis C. Eicnor, District Attorney for the Third Judicial District, Salt Lake County, State of Utah, by this information of the infamous “Crime Against Nature”, committed as follows: That the said William Dean on the 8th day of April A.D. 1901, at Salt Lake City, Salt Lake County, State of Utah, unlawfully and feloniously did make an assault in and upon one John Langenbecker, a boy of about the age of  thirteen years, with the intent, then and there unlawfully and feloniously and wickedly, and against the order of nature, him the said John Langenbecker, to carnally know,  then and there unlawfully and feloniously and wickedly, and wickedly and against the order of nature, had a venereal affair with the said John Langenbecker, and then and there unlawfully and feloniously carnally knew him the said John Langenbeker, and then and there unlawfully and feloniously and wickedly, and against the order of nature, did commit and perpetrate the detestable “Crime Against Nature”, of Buggery, with said John Langenbecker contrary to the form of the statute of the State aforesaid, in such cases made and provided and against the peace and dignity of the State of Utah.” Signed Dennis C. Defense Attorney Statement: “You are instructed as a matter of law that some penetration of the rectum of the said John Langenbecker is necessary to have been proven in the infamous “Crime Against Nature”, before you can find the defendant guilty of the offense charged, and should you not so find so find I charge you as a matter of law that you should return a verdict of Not Guilty.” -No 8 ½-If you find from the evidence that the complaining witness was of such an age as to understand the nature of the crime and consented to its commission, then it is immaterial that he is under the age of fourteen years, and I charge you that under such circumstances the said John Langenbucker is an accomplice. If you find that said John Langenbucker was an accomplice, I further charge you that if the collaborating testimony of other witnesses is not in itself sufficient to justify you find a verdict against the defendant, that you should find the defendant Not Guilty. 1902 Charge Against felt Police Officers Refuse to Swear to Complaint Where upon Chief Hilton feels it’s His Duly to Do So and Affixes Signature Accordingly-Innocent looking little 14 year old Clyde Felt Is to be tried on the charge of murder In the second degree for time killing of old Samuel Collins on the 21th of March. It was stated in last evenings “News” that it would not be an easy matter to get one of the officers to swear to a complaint against the child and such proved to be the case. It is known that more than one officer positively refused to attach his name to the document that would force Clyde to appear in court and answer to the grave charge. Chief Hilton however signed the complaint this morning and was sworn by Judge Diehl. Immediately following this formality, Assistant County Attorney Fred C Loofbourow approved the issuance of the warrant and that document was made out by Clerk Meeks and turned over to County Attorney Christensen to be delivered to Sheriff Naylor for serving. Mr Christensen said that the boy would be arraigned this afternoon but he did not anticipate a preliminary hearing.Following is the complaint in full filed thIs morning-. THE COMPLAINT State of Utah vs Clyde Felt defendant. They were Immediately followed by Judge King of counsel for defense and the boy’s father and mother, the latter leaning on her husband’s arm and a few friends. The court room was already packed with a crowd of curious people and when the boy took a seat near Judge King there was a great craning of necks to get a good look at the lad. Clyde was attired in a neat suit of clothes, a white shirt, collar and tie. Before the complaint was read there was a brief consultation between County Atty Christensen. Judge King, and Mr D P Felt. When court was formally opened Mr Chrlstenson said: “If the court please, I understand there are a number of cases on the city docket and I would like to ask that at this time Clyde Felt be arraigned.” As Clerk Meeks read the complaint in a clear and distinct voice, Clyde looked intently at him and appeared to be much Interested In the proceedings. At the conclusion of the reading Judge King said “Your honor we will take until tomorrow at 2 o’clock to plead and then in response to Judge Dlehl he said that they would not ask for the bail to be fixed at this time. Clyde was then remanded to the custody of the sheriff and the Interested persons quietly left the court room. The boy was taken by the sheriff and County Atty Christensen direct to Judge King’s office where Mr and Mrs Felt had preceded them. After a brief conference Clyde was taken back to the county Jail. The Sheriff  and his young prisoner walked back to and  from the county Jail. Deseret evening news. (Great Salt Lake City [Utah])
  •  1902 Clyde Felt May be Sent To the Reform School.  The case of Samuel Collins is about to enter on its legal phase. County Attorney Christensen has prepared a Complaint in the regular form, charging Clyde Felt with murder in the second degree and Judge W. H. King has beenretained as counsel for the young prisoner. He is to be arraigned before Judge Diehl this afternoon. An obstacle that may delay the filing of the complaint is the dificulty of findng anyone who will appear as complaining witness. The revelations as to the character of Collins have filled the community with horror, and the officers who under ordinary circumstance would be perfectly willing to take oath that a crime had been committed hesitate to swear that the killing of Collins was a great crime as murder. It is pointed out that the killing of the old man by one of the grown relatives of the boy as a punishment for Collins hideous crimes would have been so nearly a justifiable homicide that there would have been no possibility of a conviction on any criminal charge. Some are inclined to take a less charitable view of the boy’s case became, it is alleged, he did not comprehend the enormity of Collln’s and was not prompted by the excusable impulse that would have inspired an older person.  Judge W H King has been retained by D P felt, the father of the boy, to conduct the defense when the child is arraigned. Mr Whittemore remarked last night when asked for his opinion on the Felt case, that from the facts as given in the newspapers he would say that nothing more than manslaughter could be made out against Clyde. “The elements of murder, deliberation and premeditation, are wanting,” he said. “The boy was induced to perform the act by one who had a very strong influence over him. In my opinion the jury would be instructed to take this influence into consideration. I am absolutely sure that I would give it a great deal of weight if I were called upon to decide the degree of tho boy’s guilt. The penalty for manslaughter is from one to ten years imprisonment.” Technically perhaps young Felt could be held for murder in the second but in my opinion the case is devoid of the elements that go to constitute murder.” “The law is,” said District Attorney Eichnor, “that between the ages of 7 and 14 years the mental capacity to understand the nature of a crime must be shown to sustain conviction. Above 14 the law presumes that the offender has the capacity to commit a crime unless some evidence is offered to show that the capacity is lacking. Judge O W Powers holds that a boy is liable to be charged and convicted of murder in any decree the same as a grown person. “This case,” he says, “seems to have been a willful deliberate premeditated killing done under circumstances in which the law would imply malice. Malice is of two kinds express and implied. Express malice must show deliberate intention of unlawfully taking human life. Implied malice is where no considerable provocation appears or where the circumstances attending the killing show a malignant and abandoned heart.” Judge Dicksons says, “A boy 14 years old charged with murder is the same as a grown person in the eyes of the law.  If found guilty of manslaughter, he would go to the reform school instead of the penitentiary. In view of Clyde Felt’s age I do not believe that he ought to be convicted of murder. Clyde was arraigned before Judge Diehl at 2 this afternoon on the charge of murder in the second degree. The date of his preliminary hearing will be fixed forthwith and it is regarded as probable that his attorney will put up a strong defense at the hearing as there seems to be nothing gained by delay and the boy is very anxious to leave his quarters in the county jail. yesterday he seemed more anxious and uneasy than at any time since his arrest. He seems to realize more and more the serious nature of what he did in Hell’s hollow. The gloomy weather outside had a part in putting him in this penitent frame of mind. His eyelids were red with weeping and he complained to the attendant at the jail that lhe did not feel well. Twice during the day D P Felt called upon his unhappy little son. The second time he came, he brought a new suit to replace the worn garments in which the boy was arrested. Clyde was not so depressed as to be past the appreciation of his appearance and he showed considerable pleasure in getting into the new clothing. He does not relish the attention he attracts from strangers and told his father indignantly of two persons who stood and looked in at him through the grating. “I got back here,” he said illustrating his position, “so they could not see me. Tthe jailers are very considerate of the boys feelings and do not knowingly permit any one to gaze at him for the satisfaction of their idle curiosity. They also refused to admit a number of his acquaintances who called to see him without the consent of his father. Clyde has no reason to complain of his fare.  Every little dainty that the jail kitchen affords is placed before him to tempt his appetite which by the way needs little temptation. He eats as every healthy boy can eat and relishes everything from roast beef to cake. To his father, last night, he explained some of the further details of the disposition of Collins effects after the killing.  He still professes ignorance of the butcher knife on the ledge above the cave but explains the finding of the pocketbook on the side of the hill. “As I came up the path Tuesday morning I found the purse in the path about where the ow man had undressed. I picked it up to see if it was worth keeping but when I found it had a hole in it I through it away without noticing particularly where it did go but I think I threw it north. Then I took off my coat and laid it on a rock while I finished building the wall. I had it built pretty near to the top when I thought I heard some one coming and hid down back of the rock a minute or two. Then I came out and ran down out of the hollow. I don’t know how one of the shoes got up on the ledge for I am sure that I set them both together by a little stump in front of the big rock that bars the entrance to the cave. I did not think about hiding them.” “Honest, pa, I don’t know anything about how the knife got there unless the old man brought it up before. He might have had it in his bundle because I did not see the bundle when he opened it.  C H Woodward, the old gentleman who gave Collins 500 shares of stock worth between $50 and $100 still has confidence in the honesty of his friend. There is little doubt that Collins got the money and either spent it or kept it. The disposition of the money is somewhat of a mystery as Collins left several small bills when he went into the hills to his death. It is believed that he may have gambled the money away as he was addicted to that vice, and when under the influence of his favorite drug would talk of winning and losing money on cards. Clyde Felt says he does not remember seeing the old man in possession of any considerable sum at any time. Ogden Standard 1902-04-08
1951 - Male Chorus Lauded at U.  More than 650 persons came to the U of U Sunday to hear Utesville’ fifty voice male chorus at its best in the 2nd  informal at home concert.  The overflow crowd of 650 concert goers got the full treatment from the lilting Schubert to a moving reading of Lincoln’s Gettysburg Address. Show stopper of the day however was the familiar “Stars of the Summer Night” which gave many listeners their first chance to hear the pert Chi Omega Quartet. Guiding the chorus was John Marlow Nielson with Soprano Lucretia Ferre as guest soloist. Salt Lake Tribune (Pg. 17 Col. 6)

1977  With Mr. Wallace and his attorney pressing them hard, the police were finally forced to admit the truth about the matter:  "Salt Lake City police officers admitted Thursday that the accidental wounding of an undercover officer occurred during surveillance of Mormon dissident Douglas A. Wallace....    "Reports released Thursday by both the county sheriff's office and the county attorney show that six officers     were on stakeout around the John W. Fitzgerald home...where Mr. Wallace was staying.  "The lawmen were paired up in three police vehicles and two of those were parked close together in opposite      directions..."

1978- SLC’s Gay Service Coalition Meeting was held with Ken Kline, Bill Woodbury, John Meng, Ray Henke, and Mike Reid. Elected ad hoc to the Board of Directors were Joseph Dover, John Meng and Ray Henke. Cam Morrison formerly involved with the Open Door and elected member of the GSC board was formally discharged as affiliate of either for his mishandling advertisement with Club Comeback. Final disposition of small claim courts proceedings against the Comeback Club to pay Open Door $96.00.  The Comeback Club advertised in three issues of the Open Door but was not informed by Cam A. Morrison  concerning the costs of the ads. The Open Door  arbitrated and settled for the cost of only one ad in the paper. The Comeback Club was ordered by the small claim court to pay the Open Door which they did.

David Chipman
1980 The judge who initially tried the David Chipman case, David Sam, was also a Religion instructor at BYU and refused to dismiss himself from the case for conflict of interest. Sam in fact indicated that "my background and religious training enforces and strengthens my professional duty to be entirely unbiased and unprejudiced in any matter brought before me as a judge". Clearly, however, Judge Sam's subsequent actions confirmed that he was anything but unbiased. On April 8, 1980, at the end of the trial, Judge Sam, "[o]n his own motion" and "without legal precedence", ruled that "there was insufficient evidence Chipman committed the crime, but enough evidence he attempted to carry out the crime" (although what that evidence was, is not clear). Chipman was then found guilty of a lesser offense. Attempted forcible sexual abuse was only a class A misdemeanor, not a third degree felony. However Chipman's lawyer, fellow Mormon Ronald R. Stanger, felt that "it wasn't the judge's place to find Chipman guilty on a lesser offense" and that the ruling should simply have been guilty or not guilty of the charge of forcible sexual assault. Judge Sam also received further notoriety in 2003 for summarily acquitting two members of the Salt Lake Olympic Committee, Dave Johnson and Tom Welch, who had been caught bribing International Olympic Committee members with money taken from a humanitarian project for impoverished athletes. Ten IOC members lost their positions for receiving the bribes. Judge Sam's decision to acquit the bribers drew international criticism. (Connell O’Donovan)

1989 I went to bed about 2:30 a.m. this morning after calling Mark LaMarr, and Dean Shute, Darrell’s former house keeper who had moved to California. This morning I woke up at 6:30 and could not get back to sleep. Darrell’s sweet smiling face kept beaming at me. About 7:30 I started calling people because I wanted people to hear about it first before reading about it in the papers. That’s what a family does. I called the remaining officers of Unconditional Support, Alan Peterson, Mike Casey, Randy Olsen, and Rocky O’Donovan of the Historical Society. That was really hard for me to do but I wanted them to know about it immediately. Mike and Alan seemed to take the news very hard and broke down over the phone. Wish I could have told them in person.  Dean later called me from California and said how grateful he was that I called him and said he knew that if anyone was ever to call him, he knew I’d be the one who would be that thoughtful. Thoughtful or not, its common decency to let people know about tragedy concerning people they have known and loved. Dean and Rich are making arrangements to come back to Utah for the funeral. The viewing will be Monday six to eight and the graveside service will be Tuesday. How ironic. Last Tuesday at Unconditional Support Darrell was alive and full of laughter and fun and now he will be buried this Tuesday.  I tried calling John Reeves in Boston this morning but he’s probably at work. There was a small blurb in the local section of the Tribune about the murder. It didn’t mention Darrell’s name. I wasn’t sure all day whether I was going to attend Affirmation’s dance tonight; but after remembering what Darrell said about supporting it, I decided to go. As I was walking over to catch a bus to the Unitarian Church I saw Doug Fenstermacher in the parking lot of Burger King with his limo. He offered me a ride up to the dance in the limo and he wanted me to ride in the back but I said certainly not. I am no celebrity. I wanted to sit with him and visit in the front where I gave him a little neck massage and a hug. When I stepped out of the limo at the church, I kissed Doug goodbye and Chuck Thomas and Dave Malmstrom were out front, who had come to the Affirmation dance in a limo! They looked so shocked when I stepped out and they asked me, “How do you rate?”   Malmstrom teased and said “I’ve heard you were good but not that good!” and I simply replied, “Well I am!”. The dance was fun but there was a small turn out. I only stayed until 10:30 myself, about an hour. I danced some not to be a wet blanket but my heart wasn’t in it. I think Rick Eden, Jim Hunsaker, Derek Streeter, and myself were the only ones from Unconditional Support. The rest were too upset over Darrell. His death has cast a real pall over our little community. When Derek left I got a ride home with him. At home I just stayed up watching Saturday Night Live and taking phone calls from people as they heard the news and wanted someone to talk with. I’m so glad I made arrangements to take Monday, my birthday, off from work. {Journal of Ben Williams]

1990 Mike Pipkim and I went to Affirmation for the first time in years.  Anyway after the official presentation I got up and gave the scoop on the "You don't have to be Gay" Evergreen Conference.  Mike Pipkim said that they were putting up posters at the Magazine Shop and I suggested that if anyone sees this garbage take it down.  But Duane Dawson who is now the director of Affirmation was being real prissy, saying not to take down the posters or they'd have the right to take ours down too. And I responded "Well they do anyway, and if I saw a Poster with a Swastika on it  I wouldn't hesitate to take it down too."  After the meeting I went up to Duane and told him how disappointed I was with Affirmation these days for not refuting Dr. Black's bias against Gay people.  I asked him point blank "Why don't you have Gay people speaking to Gay people about Gay issues any more at Affirmation,  rather then bringing in all these LDS heterosexuals?  Who are you trying to get approval from?"  He just nastily said "We have a new focus."  I suggested back at him, "You ought to start re-affirming your own Gayness or at least take an inventory of what is Affirmation's leaders own concepts of what being Gay are.  Leadership demands integrity and a Gay focus!"  Well anyway Duane was so angry with me that Mike Pipkim over heard him say, "I could just slit that Ben Williams' throat!"  He must have learned that in the temple. Ha!  Anyway good! I'm glad I got him riled up.  Several people after the meeting came up to me wanting to know more about this Jeff Konrad creep who is touting himself as a “cured homosexual” and is in town to promote his book at the Evergreen conference.  Strange that there's always a buck involved in all these cures.  Doesn't Duane Dawson realize that Gay people are intrinsically interested in our issues and only Gay people can truly know what Gay people are going through? What the hell do heterosexual experts know about the Gay Spirit?  I really don't care if people like Duane Dawson and Keith McBride hate my guts as long as they know they will be held accountable for their reactionary homophile positions and will be called on the carpet for the damage they cause.

1993 Salt Lake City taxi drivers are tense while a fellow cabby lies hospitalized with two gunshot wounds to the head.   ``A lot of drivers are saying, `What if we start packing [guns]?' '' said cab driver Cory  De Young. ``When I heard about the shooting, I started to want to carry a gun.''   De Young was a former police informant who had the Sun Club investigated for drugs in 1986.

Sue Hyde
2003 The Gay & Lesbian Community Center of Utah hosted a reception for Sue Hyde, NGLTF (National Gay & Lesbian Task Force) Creating Change conference coordinator in the gallery room (361 N 300 W). Sue is here on a site inspection tour of Salt Lake City in consideration of placing the Creating Change conference here.. For your information:  the Creating Change Conference is the largest gathering of LGBTQQS grass roots activists in the country. It draws between 3000 and 5000 people annually depending upon location. I have been attending Creating Change for the past 6 to 8 years and usually find it helpful.  Sean Burke developed an LGBT Convention Bureau and submitted the proposal. I know very little about the proposal. However, the reception will give you an opportunity to meet with and talk about Salt Lake as a potential site for the conference and/or to learn more about this event and the NGLTF. The reception is open to everyone, so please feel free to share this information widely. RSVP is not necessary but would be helpful.  Paula Wolfe Executive Director Gay & Lesbian Community Center of Utah

2003 Chad Keller to Royal Court Subject: Rainbow Fund Dear Bob, [Childer] Wow! Coronation is almost here. The 27th Reign is to be commended for exceeding the expectations of the community, and importantly raising the standard.  Each year it amazes me of the many works that the RCGSE does to better our community.  It will definitely be one for the history books. I write to you today on behalf of the Utah Stonewall Historical Society. In October the Utah Stonewall Historical Society will join with other national Lambda history groups around the nation to host National Gay and Lesbian History Month.  We would like to make application for funding from the RCGSE from this fund or other disbursement alternative.  The RCGSE will be considered a Founding Sponsor for the 2003 USHS Conference. The Utah Stonewall Historical Society is established to promote the recovery, preservation and understanding of the history of the Lambda people. Our history is best served by preserving the records and cultural artifacts of our people and our events and by recording our observations. The USHS is dedicated to preserving and interpreting all of these as part of an important historical record and legacy to the state of Utah. Our primary focus is on Lesbian and Gay history and culture along the Wasatch Front in Utah. We are an all-volunteer and nonprofit organization governed by a volunteer Board of Directors.  We are also interested in partnering with the Court to insure that the history of our community is talked about and reflected upon as much of the history of the community is also part of the RCGSE's history.  It principals of excellence and standards can be seen in our communities many organizations that the court influenced from its inception.  I know as we have looked to find board members the first place we looked was the RCGSE.  We would be honored to receive assistance from the Court for this mile marker of our community.  Also as part of the conference we are in the process of designing a special event, Coffee, Conversation & Community, which would focus on the collective stories of our community through the eyes of the RCGSE College of Monarchs.  Final details and presentation are still in the works, but this event would be a special one time recorded interview featuring as many past monarch's that are willing to participate and insure our history. Please let me or Ben Williams know what the application process is.  We will be happy to meet with you and the Board of the RCGSE to discuss the Conference.   Sincerely, Chad Keller  co-Chair, Curator Utah Stonewall Historical Society

2003 Chad Kelller to Charles Milne - Subject: Kiosks Charles, I have not heard from you regarding the topics that you would like discussed on the History kiosks for Pride Day.  USHS is happy to move forward, but we need to get to Ben the possible subjects for each of the 36 Panels.  The clock is ticking for us, and we would like to have information prepared, and panels designed and printed by May 31, 2003. As you are aware, due to USHS sponsorship agreements, advertising on the kiosks for people other than USHS Sponsors was to be limited.   I have several inexpensive options for you for Pride Sponsors and Stage line ups, which will help you meet the obligations of the Pride Sponsor, and us keep our arrangements. Please let us know what's up, or call me and we can discuss the list of possible subjects.   I will send to you a word document today with the tentative subjects ones I have come up with that I think Ben will have information on.   Missed you at LGSU last night. Thanks! CK USHS
